I bought it from the Nintendo shop (I had a voucher to use on there) so its been pre-loaded for a few days - and yes if you click to start it wants to check into the server to see if its released yet and then gives you a 'computer says no' message :-(
On the plus side its Wednesday , so we only need to wait until after midnight tomorrow !
