So here's the thing. I cleaned my car at the weekend, and no matter how hard I try, tons of little bits of dust and crumbs just stay stuck in the upholstery, after I brush and hoover. That chap there seems to run his hoover over it and all the stuff just happily shoots up his pipe.

What does he know that I don't (aside from how to clean cars)?

Yeah, I had a similar crash when I was 17 just after passing my test and the guy I hit was similarly chilled about the whole thing. It always stayed with me. Well done for being that guy, Kov.

If it's anything like mine, the insurance claim for the car should be simple and easy to sort out, I was only without a car for about a couple of weeks.
The claim for injuries or to get your excess back, and to get it resolved as a non-fault will take forever. Mine is still ongoing and it's coming up to a year ago now.

I’m glad everyone is ok. Head-on collisions cause the most death and injuries so it’s remarkable everyone walked away intact, thank goodness.

As the resident PI guy, this is misleading.

First, your insurers should be recovering your excess if liability is admitted.

Second, no fault RTA injury claims take weeks/months not years unless your injury hasn’t recovered or you have multiple injuries requiring experts of various specialities (or liability is denied of course). Your average whiplash claim should take no more than 3-4 months and often quicker because:-

(a) Under the MOJ Portal - liability must be accepted in 3 weeks;
(b) then you get a medical report from a GP (takes a few weeks depending on when you can get an exam); and,
(c) once the medical is agreed and disclosed the insurer has 3 weeks to respond to your evidence.

So unless there’s a dispute over who is to blame, which may involve the Courts to resolve, a typical claim doesn't take long at all.

I've been trying to buy a flat for god knows how long, and everything that could go wrong so far has gone wrong. So post January this year as part of the Grenfell fire follow-up there's a new process for lenders to assess risk of issuing mortgages on flats. The valuer conducts a valuation. If the building is taller than 18m or the valuer notes that there are cladding materials that may possibly be combustible then the lender requires that the buyer provide an EWS1 form completed by a fire safety certified chartered surveyor to confirm that the cladding materials will not support combustion.

There are problems with this.

Firstly, the surveyor is not a fire safety certified chartered surveyor, therefore if there is cladding, the valuation will by necessity state that there are cladding materials that may possibly be combustible, triggering the EWS1 process even in low-rise buildings
Secondly, there are nowhere close to enough fire-safety certified surveyors to meet the demand for these forms
Thirdly, insurers are advising the certified surveyors not to fill out and sign the EWS1 forms due to liability risks

It's effectively impossible right now to buy or sell a flat with any cladding of any kind.

:( Are most of the flats that you are looking at cladded? Is that the norm for blocks of flats? Ours are cladded, but I don’t think over 18m (three storeys, low ceilings, most be closer to 9m, I think?) Are there no lower-rise flats where you are looking, or are you looking specifically at high rises?

Oh man, that's an issue and a half!

You'd have thought it would be in the interests of the management company and/or building owners to get the building assessed so that when this comes up, there is a document or certificate that the valuer can just go look at. Would they not need something along those lines for their insurance, anyway? Surely if you don't prove your building can turn into a giant candle, your insurance would be astronomical so it'd be sensible to do, just to reduce that liability?

I know it probably doesn't help you. Is it a question that could be asked though? Just throwing ideas around, really.

Is this a particular flat, or just any that you have seen?

I understand this in principle, but as with many other things, in practice... :(

There's no real motivation from the management company who are the leaseholder to get it done, unfortunately - they don't care if the individual units are bought or sold. I don't believe there's currently any insurance implications

Surely if you don't prove your building can turn into a giant candle, your insurance would be astronomical so it'd be sensible to do, just to reduce that liability?

I know it probably doesn't help you. Is it a question that could be asked though? Just throwing ideas around, really.


There's no real motivation from the management company who are the leaseholder to get it done, unfortunately - they don't care if the individual units are bought or sold. I don't believe there's currently any insurance implications

The management company usually own the freehold. When you buy the flat you tend to own the leasehold.

Yeah they have absolutely no interest in doing many things from my experience, and then charge you £350 for a “sellers pack” which basically includes a couple of documents.

Yeah, and part of the problem is that the people qualified to fill out the survey are thin on the ground, so they're able to charge a fortunate to get it done even if you can find someone.

No kids, you're not married (unless my invite got lost in the post) so you have no dependents. I'd buy a Dutch barge and convert it. They're surprising capacious inside and cool as fuck. Granted, they don't increase in price anywhere near as well as bricks and mortar. Just a left field thought. No idea what they cost, but they were pretty cheap comparably the last time I looked. I've been on a few conversions and they are a lot bigger than you think. I suspect annual maintenance costs would be on a par with owning a flat as well.

If only you knew any skilled carpenters to help ;)
