*blink* Oh, if perhaps someone worked in a legal capacity and were troubled by visiting a site (this one) that has links within it to 'grey' sites? Um. Then I can only suggest that if a person is that troubled by a word or two, then they ignore it. It's very different from posting a big picture of some tits, or something. Otherwise, I can't see what you mean. It isn't illegal to link to http://www.torrentz.com - this isn't simply my opinion. Unless you're referring to someone visiting from a country with particularly draconian copyright laws or something - in which case to be honest, the other stuff that gets talked about on here is going to pose bigger problems to them, I would imagine, in its volume.

but you miss my point - i do not understand why you keep doing it. you have no need to, and you have been asked not to. nobody said it was illegal, but then neither are pictures of naked people. if it is funny and i am missing the joke than i am sorry.

It's an important distinction.

This isn't the pirate bay, which hosts torrents.

It's the same as linking to a google search for torrent.

Actually, thinking about it, the whole internet contains copyrighted items (the words on every webpage), and we don't have specific consent from the owners to link to any of them. OH NOES.

There is a problem with the drafting in that it seems to say "do not post download links... to sites that link to copyrighted items", which makes no sense. It should be "please do not post download links to copyrighted items or post links to sites that link to/contain copyrighted items [/b]unless permission has been given by the copyright owner".

EDITED-IN HOWEVER - I would suggest that the Rule is replaced with this:

"Do not post any links, whether download links or portal sites, which if clicked on by a BETEOer would constitute a criminal offence or an actionable civil wrong in the UK".

Yes, indeed you could. AFAIAA, Torrent sites themselves aren't illegal in this country yet, and you can't be sued by the MPAA or whoever for going to one, if you don't download anything.

Here's the problem:

If the rule isn't there at all, then this forum becomes a site that 'hosts links to torrents' - not technically illegal right now, but I don't give it that long.

If we try and be specific about what is/isn't permitted, there will always be ways around it, or people saying "but if you say that, it rules out xyz too!".

If we are vague about what is/isn't permitted, then you'll end up with people saying "well I didn't really know what that meant, so I posted it anyway".

So, what we're after is something clear, that encompasses all the options. How about:

Don't post links to things that are themselves illegal or that would be illegal to download. If you're unsure about exactly whether a link might be illegal, err on the side of not posting it.

I like what Craster said: "Don't post links to things that are themselves illegal or that would be illegal to download. If you're unsure about exactly whether a link might be illegal, err on the side of not posting it."

It places the responsibility on the poster, and it specifically states that it's legality that is the issue, not the act (e.g. piracy) that might circumvent that. To tie in with that, but not immediately following, I would add some final boilerplate that just says "This forum is non-profit, ran for fun by volunteers. If you have any grievance, be it personal, legal or otherwise, please discreetly contact a moderator, who will be happy to discuss the matter with you. We don't want no trouble, now."
