Well, I dropped a nice carafe the other day, I'd like it replaced without paying for it a second time. Can I walk into the shop and nick another one?

As pointed out to me lots and lots of times... Piracy is not steeling etc etc.

I own the license for the game, so I just need a way to get media to play..

It's not quite the same though as he still owns a license to use the software.

EDIT: Fucksocks.

I'm not sure that's strictly true, actually. The terms of the shrinkwrap licence are very restrictive, and relate (I think) only to the copy of the software on the physical media sold to you, and one installation on a PC, and are dependent on possession of the physical media. I'm sure someone can correct me.

Piracy isn't literally or legally "stealing", no, but breach of copyright is, like, a crime and that. They're totally direspecting your rights, isn't it. Isn't it? Standard.

Not true, I have downloaded Win 7 for example, I obtained a license for Win7 they are not linked. So I can download Win7 as many times as I need to, but can only use the license on one machine.

Yeah, but that's the licence for a download, so would be different. The limit there is the number of machines you can have it on at one time. I may dig out some of my old boxed PC games and see what they say about all this. I have a copy of DK2, as it happens...

Similarly, if you've bought, say, an Abba CD, if you snap it, do you think Sony or whoever are going to not sue the bollocks off you for downloading it illegally?

I don't see how, as they already have the money for the copy I bought.. It is not like I am depriving them of a sale..

Why not? You might buy it again if you didn't pirate it.

Yes you are - the sale of the replacement. As with the music CD. They (the bad industry people and their licensing arrangements) don't see the media and the copyright material as being particularly divisible, at least when it comes to music and films. As I said, I'll check on the PC games.

There was something recently in the US that upheld, based purely on case precedent (ie it doesn't matter what the judge thought, his hands were tied), that you own the copy of the software, not a license to it, no matter what the rights holder says. So fair use and first sale and so on are entirely valid for software.

Thinking about it, if it wasn't dependent on possession of the media, you could install a game, sell the CD and then just download it from torrentz forever more. And I'm sure their lawyers would have covered that.

Bik - the judge's hands weren't tied as such, he chose one of two precedents, and went along with a bonkers one that was about something entirely unrelated. Photos of Vanessa Redgrave, that was it.

What about any other physical good, like a kettle or a TV or a car? If it breaks you're allowed to fix it, your options aren't simply "buy a new one" or "steal another one".

Download and burn.

When repairing a kettle or a TV or a car you aren't restricted to the existing component parts, you can chop and change as much as you like. Second hand parts from other manufacturers if you like. You could even turn your kettle or TV or caaaaarrrrrr into something else entirely, like a Tomkattle.

Depends, some let you make a single backup copy, others let you install it on a few machines as long as you only use it on one machine at a time & others still are restrictive as fuck & only let you install it on one PC ever. New PC, new license.*

Then you've got the various "Free Software" licenses...
*Ever since I did that music course I've read the small print & licensing agreements on stuff. It's both a blessing & a curse I tell you.

True but the licencse is unique, as with BF2 and BF2142 I bought pre-owned. The license belonged to the first owner. EA had to issue me with a new license so I could play.

I do see what you are getting at.

It just seems to differ from software type to software type.

With my music I copy the CD as I don't like have the originals in the car..

You know the worst thing about pirated movies? It's when the file ends as soon as the credits roll, and all you see is your computer's desktop.

Maybe I'm alone here, but when I've just watched a particularly good film, I like to use the credits to reflect upon the whole thing; to listen to the music and have a good ol' think about everything. It's such a huge shame when the person who ripped the film deemed file size to be more important than completeness.

Fortunately The Curious Case of Benjamin Button had the credits in their entirety, I had a good think about life, and now I'm happy. And sleepy.

It's been ages since I've seen a film with no credits. Maybe that's because I normally stop it pretty quickly once the credits start, but I didn't think they did that sort of thing any more.

I find that annoying in TV torrents. I've watched a few (House is a prime offender) that leave something dangling right before the credits kick in, sometimes in the middle of sentence, Sopranos style. With the credits cut off, you're never sure if you've missed something.

Buy the DVD then, you filthy scum! You wouldn't steal a lady's handbag.

I don't know what goes on in Toffton-upon-Posh but round here they tend to have purses inside handbags.
