See, that sort of thing is bang out of order. In fact operators laying a finger on the phone is something I'm just about entirely sick of. Mercifully android makes it possible to override their pointless vandalism of decent operating systems with ease.

If my local garage sold me a car and when I got home I found they'd taken the engine and replaced it with something slower, thirstiest and which doesn't quite fit in the compartment, they'd soon be out of business. It's most frustrating that these piss artist phone networks do the same thing and so few seem bothered by it.

The operator doesn't do anything at all to the handset or the firmware. Apple absolutely won't let them, it feels the same way about it that you do. Every iPhone world wide is identical, in hardware and software. The remote switch is baked into the firmware by Apple. All the operator can do is disable or enable it, similarly to how (once upon a time) they would enable or disable 3G data or (even longer ago) SMS support based on your tariff level.

And if that switch wasn't there, there's still any number of ways they could detect that the traffic was very likely tethered traffic and block it.

Oh, absolutely. There's been numerous cases in the US of operators cutting off people using unofficial tethering. It hasn't happened in the UK, to my knowledge, but that doesn't mean it won't someday.

Is tethering that thing where you can create a personal hotspot? If so, we are on 3 PAYG and the add on that gives you 300 any network mins, unlimited text and unlimited data allows this.

Just got a text message from O2 telling me I was bumping up against my data cap. This seemed unusual as I've never gone close (last time I looked, usage was 1.2Gb over a 6 month period with a 500MB monthly cap). For Reasons, I reset in June, and in 6 weeks, I've hit 705MB.

Looks like the reason is the fucking Podcasts app, and that instead of playing downloaded versions, it has still streamed them when I've listened on the train. I did actually think that this may be happening previously, but I looked and the spinning sun of data wasn't present. Arse, and another fail for that app. Maybe they'll make it work properly in v3.

I binned the podcasts app very quickly, it was slow and buggy, and pretty awful to use. Moved back to the music app within about 15 minutes!
